Nachdem vor einigen Tagen einige Fansites zu 'Baldur´s Gate II' aufgefordert wurden, rollenspiel-spezifische Inhalte zu entfernen, die sich auf das AD&D-System beziehen, wurde nun eine Stellungnahme von Amigo-Spiele und Wizards of the Coast veröffentlicht:
"Liebe Baldur’s Gate und AD&D/D&D Spieler,
aufgrund der aktuellen Situation möchten wir Euch auf folgende Punkte aufmerksam machen:
Da die Logos, Bilder, Inhalte und auch Begriffe von AD&D/D&D urheberrechtlich geschützt sind, stellt jede unerlaubte Veröffentlichung eine Urheberrechtsverletzung dar. Wenn jemand einen urheberrechtlich geschützten Text, eine Zeichnung oder ähnliches Dritten zur Verfügung stellt (auch nicht kommerziell) ohne eine Erlaubnis des Urhebers zu haben, verstößt er gegen das Urheberrecht. Eine Einschränkung hierzu stellt die wissenschaftliche Verwendung von Textauszügen und die Veröffentlichung von kleineren Auszügen zum Zwecke der Rezension dar. Eine kommerzielle Nutzung ist auch dann gegeben, wenn Werbebanner auf einer Homepage zu finden sind. Zur Information liegen diesem Brief die offiziellen Online Policies von Wizards of the Coast (WotC) bei.
Da WotC und wir von AMIGO die aktive Rollenspielgemeinde unterstützen, wird im nichtkommerziellen Bereich die Verwendung von Begriffen und Namen in der Regel ohne Probleme geduldet. Jeder Veröffentlichung von Textauszügen aus AD&D-Produkten und Logos, die den von WotC gegebenen Rahmen verlässt, müssen wir jedoch nachgehen.
Bisher sind wir in der glücklichen Situation, dass wir noch keine Abmahnung aussprechen mussten. Wir versuchen immer in Kooperation mit dem Homepage-Besitzer eine gemeinsame Lösung zu finden.
Wir (WotC und AMIGO) unterstützen die Rollenspielgemeinde auf vielen Ebenen. Neben besonderen Aktivitäten, wie dem Fantasy Spiel Fest, der Fantasy Live! Internet-Show, und der Kooperation mit Software-Firmen spielt gerade das Internet für uns eine wichtige Rolle.
Wir möchten unsere Fangemeinde möglichst optimal unterstützen. Dementsprechend verbessern wir ständig unsere Fanaktivitäten, insbesondere die Homepage.

TSR, Inc. Internet Policy
The following policy statement briefly summarizes TSR's approach to use of our intellectual property on the internet.
1.If you want to use a TSR trademark, go ahead and download one of the files located at our player logo page. Use of these logos is on the condition that you don't generate any revenue from the site at which it is used. All of our other logos are off limits. Use of our word trademarks is okay provided you are using it only as text and let people know that it is our trademark. Also, make sure that users understand that there is no relationship between yourself and TSR.
2.Yeah, the artwork is pretty amazing, but please don't load it onto your web site. We can cut non-profit web pages a little slack, but in no event may you place more than one or two images on your web site.
3.Don't quote large sections of text from our products. A couple paragraphs for purposes of commenting on the product is fine, but more than that is off limits. As with trademarks, we're going to be pretty tough on stopping any use of our material that is used to generate revenue for someone else.
4.Go ahead and write your own adventures, stories or rules variations, but make them original. We would also appreciate it if you could use a little class - sure, pornography and graphic violence sell, but we try to keep a respectable image, and we need your help.
5.Go ahead and create your own MUD, MUSH, or even video game, but (i) don't use any of our illustrations and (ii) don't try to make any money from it.
6.Remember, ours is the only official TSR home page. If you hold yours out as official, or lead people to believe yours is official, we'll have to ask you to make some changes.
If you've got any further questions, direct them to our webmaster. Failure to comply with the terms of this policy is a violation of intellectual property laws and may compel Brian Lewis, one of our in-house attorneys, to take corrective action.

We have been getting a lot of "is this OK to do this under the policy" questions. Let us clear it up right now. According to the policy (above), as long as (1) you're not copying our text, (2) you're not copying our art, (3) you're not copying our logos, and (4) you're not making money off of it, you can use our properties to make your own fan material (within good taste - no porn, etc.). That's it. Make your stuff. Have fun.
